1. Acceptance of Terms
By accessing or using StudyStack ("study-stack.com"), operated by Leonenko Group LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms apply to all visitors, users, and others who access or use the Service, including teachers, school administrators, parents, and students.
2. Description of Service
StudyStack is an AI-powered education platform that helps students and families create interactive study materials including flashcards, quizzes, practice tests, and study games from class materials. The Service uses artificial intelligence to generate and personalize educational content.
3. Account Registration
- You must provide accurate and complete registration information and keep it up to date.
- You are responsible for safeguarding the password and for all activities that occur under your account.
- You must be at least 18 years old to create a teacher or parent account. Student accounts may only be created by or with the consent of a parent, guardian, or authorized school administrator.
- One person may not maintain more than one free account.
4. Subscriptions and Billing
- StudyStack offers both free and paid subscription tiers. Paid subscriptions are billed monthly or annually as selected at purchase.
- Subscription fees are non-refundable except as required by applicable law or as explicitly stated in our refund policy.
- We reserve the right to change subscription pricing with 30 days' advance notice. Price changes will not apply to the current billing period.
- You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
5. Content Ownership
5.1 Your Content
Content you create using StudyStack belongs to you. You retain full ownership of all educational resources, lesson plans, worksheets, and other materials generated through the Service. We do not claim any intellectual property rights over your generated content.
5.2 Uploaded Content
You retain ownership of any content you upload to the Service (including documents, images, and other files). By uploading content, you grant us a limited license to process, store, and display that content solely for the purpose of providing the Service to you.
5.3 Platform Content
The StudyStack platform, including its design, code, branding, and documentation, is owned by Leonenko Group LLC and protected by intellectual property laws. You may not copy, modify, or distribute platform content without our written permission.
6. Acceptable Use
You agree not to use the Service to:
- Generate content that is harmful, threatening, abusive, or otherwise objectionable.
- Create materials that infringe on the intellectual property rights of others.
- Attempt to reverse-engineer, decompile, or extract the source code of the Service.
- Use automated scripts, bots, or scrapers to access or interact with the Service.
- Share your account credentials with others or allow unauthorized access.
- Use the Service for any purpose that violates applicable local, state, national, or international law.
- Misrepresent AI-generated content as original work in contexts where disclosure is required by your institution.
7. Student Data and FERPA Compliance
We take the protection of student data seriously and comply with the Family Educational Rights and Privacy Act (FERPA) and applicable state student privacy laws.
- We do not sell student data to third parties, and we never will.
- Student education records are used solely to provide and improve the Service.
- Teachers and school administrators retain control over student data and may request deletion at any time.

8. AI-Generated Content Disclaimer
Content generated by StudyStack is produced using artificial intelligence and is intended as a starting point for educational materials. While we strive for accuracy and standards alignment:
- Generated content may contain errors or inaccuracies. You are responsible for reviewing and editing content before use.
- We do not guarantee that generated content will meet all requirements of your specific curriculum, school, or district.
- Professional judgment should always be applied when using AI-generated educational materials.
9. Termination
- You may terminate your account at any time by contacting us or using the account settings.
- We may suspend or terminate your account if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to the Service, other users, or third parties.
- Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days following termination, after which it will be permanently deleted.
- You may request an export of your content before account termination.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Leonenko Group LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by email or through the Service at least 30 days before they take effect. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
